Allahabad High Court stays Nandlal Rai’s murder conviction as he seeks to contest 2027 UP election

The Allahabad High Court suspended Nandlal Rai’s murder conviction and life sentence during appeal after considering his plans to contest the 2027 Uttar Pradesh election. The ruling removes a major electoral disqualification for now, but leaves serious questions about exceptional relief, the murder case and equal treatment before the law.

On 5 October 2026, the Allahabad High Court stayed the murder conviction and life sentence of Nandlal Rai, also known as Babloo Rai, while considering his appeal. One reason discussed in the order was his wish to contest the 2027 Uttar Pradesh Assembly election, either independently or, if possible, on a BJP ticket. The decision gives Rai temporary relief from the conviction’s legal consequences. It does not acquit him or decide whether the 2025 trial verdict was correct.

The killing and the conviction

Pramod Kumar Nigam, described in reporting as a political activist associated with the Ram Janmabhoomi movement, was shot dead in the Sigra area of Varanasi in January 2017. A Varanasi sessions court convicted Rai and Sheshnath Sharma and sentenced them to life imprisonment in April 2025. Both received relief in the High Court proceedings, according to The Indian Express.

The case has also circulated online with a striking account of its origin: that Rai was urinating near a place where Nigam was conducting a cleanliness campaign, Nigam objected, and the quarrel preceded the killing. The Indian Express attributes that account to allegations by witnesses as described by Rai’s counsel, who challenged the evidence and its timing. It is therefore unsafe to present the urination account, the exact setting outside a school, or a planned hunt for the victim as independently established findings. The killing and trial conviction are distinct from the disputed details of what led to the confrontation.

Why the High Court granted relief

Rai’s lawyers argued that he was not named in the initial police complaint and that his name emerged about 17 days later. They challenged the eyewitness evidence and maintained that the conviction rested on suspicion and circumstantial material. These are defence arguments, not appellate findings of innocence.

A bench of Justices Siddharth and Vinai Kumar Dwivedi stayed both the conviction and the sentence, and granted bail pending appeal. The judges referred to the possibility of an election opportunity being permanently lost before the appeal could be decided. They also cited the Supreme Court’s 2023 Afjal Ansari decision on staying convictions in particular circumstances, and discussed the importance of livelihood alongside political participation.

The distinction between staying a sentence and staying a conviction matters. A person may receive bail and a suspension of imprisonment while still facing the legal disqualification that follows a conviction. Section 8 of the Representation of the People Act, 1951, can disqualify people convicted of specified offences or sentenced to at least two years’ imprisonment. The Supreme Court’s decision in Lok Prahari v Election Commission of India explains that a valid appellate stay of conviction prevents that disqualification from operating while the stay is in effect. The election-related consequence is thus real, but it is neither an election ticket nor a guarantee of candidacy.

What the decision does — and does not — show

The High Court has not overturned the murder conviction on the merits. The appeal remains pending, and the stay may be reconsidered through lawful proceedings. Rai’s expressed preference for a BJP ticket is not proof that the party selected him, requested this judicial order or arranged his release. His prior political association, discussed in the court reporting, must be distinguished from any current party endorsement.

The timing nevertheless poses a difficult public question. Staying a conviction is an exceptional judicial power because it can remove immediate consequences of a criminal judgment even before an appeal has succeeded. Preventing irreversible harm to someone whose conviction could later be overturned is a legitimate consideration. But the seriousness of a murder conviction, the trial court’s findings, the rights of the victim’s family and the availability of narrower relief must also carry real weight. Treating political ambition as enough by itself would create an unjust preference for those seeking public office over other convicted appellants. The justification must lie in the particular case and the governing legal test, not in a politician’s status alone.

Where the public interest lies

This case is not proof of a secret BJP arrangement, nor proof that the trial conviction was sound or unsound. It is a documented example of an appellate court temporarily lifting the effects of a serious criminal conviction while an aspiring candidate seeks public office. The strongest public-interest issue is whether that extraordinary relief was sufficiently justified by case-specific reasons, with proper attention to the victim and equal treatment. The eventual appeal ruling, any challenge to the stay, and any actual party nomination will be decisive separate developments.
